Personal Information includes, but is not limited to, your name, mailing address, email address, telephone number, billing information, payment information (processed through third-party payment processors), IP address, and any other information you voluntarily provide to us.

By accessing or using the Site and/or purchasing any Products, Services, or Courses from Calm Hearts Collective, you voluntarily agree to be bound by these Terms & Conditions, as well as our Privacy Policy and Disclaimer, which are incorporated herein by reference.
By accessing or using the Site and/or making any purchase, you represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into this agreement. By using the Site, you understand that Calm Hearts Collective provides educational information, resources, courses, digital products, and content created by experienced educators and mental health professionals. While Bethany Hickey holds an Advanced Certificate in Clinical Mental Health Counseling and practices under professional supervision where applicable, and the founders have extensive experience in education and behavior support, the information provided on this Site is not therapy, counseling, psychological treatment, medical care, legal advice, or any other licensed professional service.
The Content provided on this Site is intended solely for informational and educational purposes and should not be relied upon as a substitute for professional advice, diagnosis, treatment, or services from a qualified healthcare provider, licensed mental health professional, physician, attorney, accountant, or other appropriate professional.
You are solely responsible for your decisions, actions, and results arising from your use of the Site, Products, Services, or Courses. If you have concerns regarding your physical or mental health, you should seek the advice of a qualified healthcare or mental health professional. Each client and his/her circumstances are unique and nothing shall be interpreted as a guarantee that you will experience the same results as another client of ours.

We do not offer any warranties, of any variety, regarding the Site, Courses, Services, and/or Products, and/or your Purchase or Download, in any way. 15. Your Release of Us:
By using the Site or Purchasing, Downloading, or using Calm Hearts Collective’s Courses, Services, and Products, you agree to release, forgive, and forever discharge Calm Hearts Collective, its subsidiaries, employees, agents, contractors, subcontractors, and affiliates from any and all claims, suits, actions, charges, demands, liabilities, damages, judgments, and/or costs, whether known or unknown, both legal and equitable in any manner.

17. Our Refund Policy:
We will do everything within our ability (and within reason) to ensure your satisfaction. Refunds will not be issued for coaching services already rendered or products already purchased. 18. Arbitration
If you have a question, concern, or dispute regarding the Site or any Products, Services, or Courses offered by Calm Hearts Collective, you agree to first contact us at [email protected] and make a good-faith effort to resolve the matter informally.
If we are unable to resolve the dispute through informal discussions, you and Calm Hearts Collective agree to submit the dispute to binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its then-current Commercial Arbitration Rules or Consumer Arbitration Rules, as applicable.
By agreeing to these Terms & Conditions, you understand and agree that you are waiving your right to file a lawsuit in court and to have your claims decided by a judge or jury, except as otherwise provided by applicable law.
Any in-person arbitration hearing shall take place in Clark County, Nevada, unless otherwise required by law or agreed to by both parties.
Any arbitration award may be entered as a judgment in any court having jurisdiction. This Arbitration provision shall be governed by the Federal Arbitration Act and applicable Nevada law.
19. Consent to Governing Law:
These Terms & Conditions, and any dispute arising out of it, shall be governed by the laws of the State of Nevada. 
20. Consent to Jurisdiction
To the extent that any dispute is not subject to binding arbitration or where a court proceeding is otherwise permitted under these Terms & Conditions or applicable law, you irrevocably consent to the exclusive jurisdiction and venue of the United States District Court for the District of Nevada or the state courts located in Clark County, Nevada, for the resolution of any dispute arising out of or relating to these Terms & Conditions, our Privacy Policy, our Disclaimer, or your access to or use of the Site, Products, Services, or Courses.
You waive any objection based on lack of personal jurisdiction, improper venue, or forum non conveniens to the extent permitted by law.
21. Consent to Service:
You hereby irrevocably agree that process may be served on you in any manner authorized by the Laws of the State of Nevada for such persons, and you waive any objection which you might otherwise have to service of process under the laws of the State of Nevada.
22. Payment & Purchases
When you purchase any Products, Services, or Courses from Calm Hearts Collective, payment must be made using one of the payment methods offered at checkout. By submitting your payment information, you authorize Calm Hearts Collective and its third-party payment processor to charge the applicable payment method for the total purchase amount, including any applicable taxes and fees. You will receive an electronic confirmation or receipt following your purchase for your records.
If you offer payment plans (now or in the future):
If you select a payment plan or installment option, you authorize Calm Hearts Collective and its third-party payment processor to automatically charge your selected payment method for each scheduled installment on the dates agreed upon at the time of purchase. You remain responsible for completing all scheduled payments until the purchase price has been paid in full.
If your payment is declined, reversed, or otherwise unsuccessful, we reserve the right to suspend or terminate your access to the applicable Product, Service, or Course until payment has been successfully completed. You remain responsible for any outstanding balance owed.
All payment transactions are processed through secure third-party payment processors. We do not store your full payment card information on our servers. Your use of any third-party payment processor is subject to that provider's own terms, conditions, and privacy policy.
Except as required by applicable law, all purchases are subject to our Refund Policy. Any unauthorized chargebacks or payment disputes may result in the suspension or termination of your access to our Products, Services, and Courses while the matter is investigated.
23. Limitation of Liability
To the fullest extent permitted by applicable law, Calm Hearts Collective, its owners, employees, contractors, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your access to, use of, or inability to use the Site, Products, Services, or Courses, even if we have been advised of the possibility of such damages.
You acknowledge and agree that you are solely responsible for your decisions, actions, and results arising from your use of the Site, Products, Services, or Courses. Our educational content is provided for informational purposes only, and you assume all risks associated with your reliance on or use of such information.
To the fullest extent permitted by law, our total cumulative liability for any claim arising out of or relating to these Terms & Conditions, the Site, or any Product, Service, or Course shall not exceed the amount you actually paid to Calm Hearts Collective for the specific Product, Service, or Course giving rise to the claim.
Nothing in these Terms & Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable law.
24. Defense & Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Calm Hearts Collective and its owners, members, officers, employees, contractors, affiliates, licensors, successors, and assigns from and against any and all claims, demands, actions, liabilities, damages, judgments, settlements, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your violation of any applicable law or regulation;
Your infringement or violation of any intellectual property, privacy, or other rights of any third party; or

This indemnification obligation does not apply to claims arising solely from the gross negligence, willful misconduct, or intentional wrongdoing of Calm Hearts Collective where such liability cannot be limited or excluded under applicable law.

Termination of your access does not relieve you of any payment obligations incurred prior to termination. Unless otherwise required by law or expressly stated in our Refund Policy, termination of your access due to a violation of these Terms & Conditions does not entitle you to a refund.
